Court of Appeal turns down application for injunction to halt transfer of Correctional Services members to AHS
Today the Alberta Court of Appeal turned down an injunction to halt the transfer of members employed as medical services staff by the Government of Alberta Solicitor General and Public Security to Alberta Health Services. The transfer is expected to take place within the next month.
AUPE applied for the injunction to halt the transfer until the court had the opportunity to hear an appeal of an earlier Court of Queen’s Bench decision to allow the transfer. AUPE has filed an appeal and expects it will be heard near the end of the year, or early in the New Year.
The Solicitor General and Public Security issued a memo to Correctional Services medical staff on Aug. 9 indicating its intention to complete the transfer soon. The memo stated:
“Work continues between the Solicitor General and Public Security (SGPS) and Alberta Health Services (AHS) to realize the transfer of correctional healthcare to AHS. SGPS and AHS have executed an agreement to to facilitate the transfer with employees’ conversion onto the AHS payroll system occurring on Sept. 13, 2010. In addition, the necessary amendment to the Correctional Service Regulation to allow for AHS to provide correctional health services is already in effect… AHS will be in contact with you over the coming weeks to provide you with more information regarding your employment offer.”
