Court of Appeal to hear injunction application Aug. 25 to halt transfer of Correctional Services members to AHS

The Alberta Court of Appeal will hear an injunction application by the Alberta Union of Provincial Employees on Aug. 25 to halt the transfer of Correctional Services members employed as medical staff to Alberta Health Services.

AUPE is seeking the injunction in order to halt the transfer while it waits for a date to appeal an earlier Court of Queen’s Bench decision to allow the transfer to proceed. That appeal hearing is expected to take place later this year.

The Solicitor General and Public Security issued a memo to Correctional Services medical staff on Aug. 9 stating:

“Work continues between the Solicitor General and Public Security (SGPS) and Alberta Health Services (AHS) to realize the transfer of correctional healthcare to AHS. SGPS and AHS have executed an agreement to to facilitate the transfer with employees’ conversion onto the AHS payroll system occurring on Sept. 13, 2010. In addition, the necessary amendment to the Correctional Service Regulation to allow for AHS to provide correctional health services is already in effect… AHS will be in contact with you over the coming weeks to provide you with more information regarding your employment offer.”

AUPE advises members that the union is continuing work to halt the transfer and stresses that it continueS to act as the representative of the affected Correctional Services members.

AUPE will provide members with updates on the union’s efforts to stop the transfer as information becomes available.
